The present conditions of sale are concluded on the one hand by Mrs Marie-Anne Hamaide, creator of “Papiers marbrés à la main”, Siret 395 212 434 00033, Code APE 9003A, registered with Urssaf n°748 7200325210, managing the PAPIERS-MARBRES.COM website, http://www.papiers-marbres. com/, whose head office is located at 14 route de la Troche 78490 Grosrouvre FR, and, secondly, by any individual or legal entity wishing to make a purchase via the PAPIERS-MARBRES.COM website, https://www.papiers-marbres.com/ hereinafter referred to as “the buyer”.

Article 1. Objet

These conditions of sale are intended to define the contractual relationship between Marie-Anne Hamaide “Papiers marbrés à la main” and the buyer under the conditions applicable to all purchases made through the website “PAPIERS-MARBRES.COM”. The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale which the buyer acknowledges having read prior to his order. Before any transaction, the buyer acknowledges being fully informed of the fact that his agreement concerning the content of these general conditions does not require the handwritten signature of this document, insofar as the customer wishes to order online the products presented on the site “PAPIERS-MARBRES.COM”.

The creator Marie-Anne Hamaide, “Papiers marbrés à la main” retains the possibility to modify at any time these conditions of sale, in order to comply with any new regulation or in order to improve the use of its site. Therefore, the applicable conditions will be those in force at the date of the order by the buyer.

Article 2. Products

The products offered are those listed on the site “PAPIERS-MARBRES.COM” of the designer Marie-Anne Hamaide, “Papiers marbrés à la main” within the limits of available stocks. The designer Marie-Anne Hamaide, “Papiers marbrés à la main” reserves the right to modify the product range at any time. Each product is presented on the website in the form of a description of its main technical characteristics (format, support, composition, motifs, colours, etc.). The photographs are as accurate as possible but are not binding on the Seller. The responsibility of the creator Marie-Anne Hamaide, “Papiers marbrés à la main” is not engaged on the display of the colours of the screens of the Internet users whatever their quality.

The sale of products presented on the “PAPIERS-MARBRES.COM” site is intended for all buyers resident in countries that fully authorise the entry of these products into their territory.

Article 3.Prices

The prices appearing on the product sheets of the internet catalogue are prices in Euros (€) including all taxes (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. The designer Marie-Anne Hamaide, “Papiers marbrés à la main” reserves the right to modify its prices at any time, it being understood that the price appearing in the catalogue on the day of the order will be the only one applicable to the buyer. The prices indicated do not include the cost of delivery by colissimo, charged in addition to the price of the products purchased according to the total amount of the order.

Shipping costs :

 

1/In France :

For all orders over or equal to 100 euros, shipping is free.

For all orders under 100 euros, the buyer will be charged a flat rate of 8 euros including VAT for shipping costs.

2/ For International :

Zone A : European Union and Switzerland

For all orders over 200 euros, shipping is free.

For all orders of less than 200 euros, the buyer will be charged a flat rate of 17 euros including VAT for shipping costs.

Zone B : Eastern European countries (non-EU), Norway and Maghreb

For all orders over 250 euros, shipping is free.

For all orders under 250 euros, the buyer will be charged a flat rate of 24 euros including VAT for shipping costs.

Zone C : African countries (except Maghreb), Canada, United States, Russia, Near and Middle East For any order over 300 euros, shipping is free.

For all orders under 300 euros, the buyer will be charged a flat rate of 33 euros including VAT for shipping costs.

The customer may also organise his shipment without the help of the designer Marie-Anne Hamaide, “Papiers marbrés à la main”. In this case, the contribution to the shipping costs calculated in the order will be immediately cancelled or refunded.

Advance payments :

Payment must be made in full at the time of ordering, except for specific offers indicated on the site. At no time may the sums paid be considered as a deposit or advance payment.

Article 4. Ordering and payment terms

Before placing an order, the buyer must create an account on the “PAPIERS-MARBRES.COM” site. The account creation section is accessible directly from the side menu bar. At each visit, the buyer, if he wishes to order or consult his account (status of orders, profile, etc.), must identify himself using this information. The designer Marie-Anne Hamaide, “Papiers marbrés à la main” offers the buyer to order and pay for her products in several steps, with two payment options to choose from:

If the payment is accepted, the order is recorded and the contract is definitively formed. Payment by credit card or Paypal account is irrevocable. In the event of fraudulent use of the credit card, the buyer may demand the cancellation of the payment by card, the sums paid will then be credited back or refunded. The responsibility of the bank card holder is not engaged if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must dispute the debit in writing with his or her bank within 70 days of the transaction, or even 120 days if the contract linking him or her to the bank so provides. The amounts debited will be reimbursed by the bank within a maximum of one month after receipt of the cardholder’s written objection. The holder shall not be charged any costs for the return of the sums.

All transactions made on the Site are secure. The customer’s banking information (for example, credit card number or expiry date) is encrypted by the SSL system and then processed by our financial partner.
At no time during the purchase process are we able to know the buyer’s credit card number, which will be transmitted directly to the partner bank through a secure connection.
Your data does not pass through the Site and only the partner bank of our Site has access to this information.

4.1/ The consumer guarantees “PAPIERS-MARBRES.COM” that he has the necessary authorisations to use the method of payment chosen by him, when validating the order form.
“PAPIERS-MARBRES.COM” reserves the right to suspend any order processing and any delivery in the event of refusal to authorise payment by credit card by the officially accredited bodies or in the event of non-payment.

“PAPIERS-MARBRES.COM” reserves the right to refuse to make a delivery or to honour an order from a customer who has not paid in full or in part a previous order or with whom a payment dispute is being administered.

4.2/ Confirmation of an order implies acceptance of these conditions of sale, recognition of having perfect knowledge of them and renunciation of the right to invoke one’s own conditions of purchase. All the data provided and the recorded confirmation will be considered as proof of the transaction. If the buyer has an e-mail address and if he has given it on his order form, the designer Marie-Anne Hamaide, “Papiers marbrés à la main” will send him by e-mail the confirmation of the registration of his order.

The creator Marie-Anne Hamaide, “Papiers marbrés à la main” recommends the customer to keep on paper or on a reliable computer support, the data relating to its order present on its customer account of the site “PAPIERS-MARBRES.COM”. The customer must verify the completeness and compliance of the information it provides (delivery address, billing address, identity data and allowing the creator Marie-Anne Hamaide, “Papiers marbrés à la main” to quickly contact the customer (telephone, email). The latter shall not be held responsible for any input errors that may result in delays and delivery errors. In this context, all costs incurred for the reshipment would be charged to the customer.

4.3/Validation of orders and electronic signature (law of 13 March 2000 on electronic signature)

Any order form signed by the consumer by “double click” constitutes an irrevocable acceptance which can only be called into question in the cases restrictively provided for in the present general conditions of sale including the pricing conditions such as “right of withdrawal” and “out of stock”.
The “double click” associated with the authentication and non-repudiation procedure and the protection of the integrity of messages constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature.

Article 5. Reservation of ownership

The designer Marie-Anne Hamaide, “Papiers marbrés à la main” retains full ownership of the products sold until full payment of the price, in principal, expenses and taxes included.

Article 6. Product availability

All products that can be ordered on the “PAPIER-MARBRES.COM” site are in stock in our premises. Each item ordered is automatically deducted from the stock. Consequently, orders are normally dispatched within 3 to 5 days of receipt of payment. .
In case of unavailability of the ordered product due to a stock error,
the consumer will be informed as soon as possible and will have the possibility of cancelling his order within 48 hours. The consumer will then have the choice of requesting either a refund, if necessary, of the sums paid at the end of the withdrawal period or the cancellation of the order at the latest of their payment, or an exchange of product of equivalent characteristics and price, if the creator Marie-Anne Hamaide, “Papiers marbrés à la main” is able to obtain it. An order can be delivered partially with the customer’s agreement. Article 7. Shipping

Packages are generally dispatched within 3 to 5 days after receipt of payment.

Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area. Orders are made by La Poste via COLISSIMO, a delivery service with tracking, delivered without a signature. Delivery times are given as an indication only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. In case of absence of the buyer, he will receive a notice of passage of his factor, which allows him to withdraw the ordered products at the nearest post office, during a period indicated by the postal services. The risks related to transport are at the buyer’s charge from the moment the items leave the premises of the designer Marie-Anne Hamaide, “Papiers marbrés à la main”. The buyer is required to verify in the presence of the employee of the Post Office or the deliveryman, the state of the packaging of the goods and its contents upon delivery. In case of damage during transport, any protest must be made to the carrier within three days of delivery.

In all cases, the amount of the contribution to shipping costs as well as the expected delivery date “at the latest” are calculated and displayed before the order is validated. This date is always given as an indication. Exceeding it cannot justify the cancellation of your order without prior agreement from us.

Article 8.  Warranty, delivery errors, non-conforming products

The products supplied by the designer Marie-Anne Hamaide, “Papiers marbrés à la main” benefit from the legal guarantee provided by articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it can be returned to the designer Marie-Anne Hamaide, “Papiers marbrés à la main” who will take it back, exchange it or refund it.

The consumer will have to formulate with the creator Marie-Anne Hamaide, “Papiers marbrés à la main” the same day of the delivery or at the latest the first working day following the delivery, any complaint of error of delivery and/or nonconformity of the products in kind or in quality compared to the indications being reproduced on the order form. Any claim made after this deadline will be rejected without possibility of appeal.

Article 9. Right of withdrawal

The designer Marie-Anne Hamaide, “Papiers marbrés à la main” respects the legal withdrawal period of 7 calendar days. During this period the consumer can return, at his own expense, the products that do not suit him. This period runs from the day of delivery of the consumer’s order. Any return must be reported in advance to Marie-Anne Hamaide, “Papiers marbrés à la main” by a  e-mail at mahamaide@free.fr. .

Exceptions to the right of withdrawal: custom-made papers.

This right of withdrawal is exercised without penalty, however the cost of return remains at the consumer’s expense. The value calculated on the condition of the returned items “Exceptions to the right of withdrawal: custom-made products” will then be reimbursed by re-crediting the bank account (secure transaction) in the case of payment by bank card (shipping costs not reimbursed).

Article 10. Responsability

The designer Marie-Anne Hamaide, “Papiers marbrés à la main”, in the process of distance selling, is only bound by an obligation of means. She cannot be held responsible for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, break in service, or other involuntary problems.

In the event of an order for a personalised product, the copyright on the creation will not be transferred under any circumstances.

Article 13. Force majeure

In addition to those usually accepted by the jurisprudence of the French courts and tribunals, the following are expressly considered to be cases of force majeure or fortuitous events: blockage of means of transport or supplies, earthquakes, fires, storms, floods, lightning, stoppage of telecommunication networks or difficulties specific to telecommunication networks external to the customers.

Neither party shall have failed to fulfil its contractual obligations to the extent that their performance is delayed, hindered or prevented by a fortuitous event or force majeure.
All facts or circumstances that are irresistible, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and that cannot be prevented by the parties, despite all reasonably possible efforts, shall be considered as fortuitous event or force majeure.
The party affected by such circumstances shall notify the other within ten working days of becoming aware of them.
The two parties will then meet, within a period of one month, unless this is impossible due to force majeure, to examine the impact of the event and agree on the conditions under which the performance of the contract will be continued.
If the case of force majeure lasts for more than three months, these general conditions may be terminated by the injured party

Article 14. Dispute settlement

The present conditions of distance selling are subject to French law. For all disputes or litigation, the competent court will be that of Versailles
